Conditions Générales et Particulières de Vente relatives à une Location en Direct

Article – 1 : Bénéficiaire

The lease concluded between the parties may not under any circumstances benefit, even partially, third parties, whether natural or legal persons, unless with the written consent of the lessor. Any breach of this last paragraph may result in the immediate termination of the lease at the tenant's expense, with the rental proceeds remaining definitively acquired by the lessor.

Article – 2 : Durée du séjour

The tenant signing this contract concluded for a fixed period may not under any circumstances claim any right to remain on the premises at the end of the stay.

Article – 3 : Conclusion de la location

The Gîte de la Collégiale reserves the right to refuse your reservation if the accredited official bodies do not validate your bank card number.

The reservation is considered validated upon confirmation by email sent by the Gîte de la Collégiale to the address you provided on the reservation form. However, this reservation will only be considered firm and final when 50% of the amount of the service has reached the Gîte de la Collégiale bank account. The payment period for this deposit cannot exceed 7 days if it is made by bank transfer. A second email will be sent to confirm this status.

Le solde devra être versé 30 jours avant l’arrivée. Tout défaut de versement du solde entraînera l’annulation de la réservation sans remboursement de l’acompte de 50 % déjà versé.

Une taxe de séjour est applicable au prix de 0.80€ /pers/nuit. Elle se rajoute au montant de la nuitée indiqué dans la page des tarifs.

The reservation is guaranteed at the rates and conditions indicated for the period open for reservations. These rates and conditions may not be renewed for subsequent reservations.

Article – 4 : Annulation par le locataire

Any cancellation must be notified by registered letter or email addressed to the Gîte de la Collégiale.

a) Cancellation before arrival at the premises:

25% of the deposit will be retained by the lessor if the cancellation occurs between 60 and 30 days before the scheduled arrival date. The lessor will retain the entire deposit if the cancellation occurs less than 30 days before the scheduled arrival date.

If the tenant does not show up within 24 hours of their arrival date, the landlord will be able to dispose of their accommodation. The deposit will also be retained by the landlord.

b) If the stay is shortened, the rental price remains with the lessor. In this case, no refund will be made, except in cases of duly justified force majeure.

Article – 5 : Annulation par le loueur

The lessor pays the tenant all sums paid.

Article – 6 : Arrivée

Arrivals are from 3:00 p.m., departures are until 11:00 a.m.

Article – 7 : Règlement des prestations annexes et de la taxe de séjour

This payment is made directly to the establishment.

Article – 8 : Etat des lieux

An inventory is jointly drawn up and signed by the tenant and the landlord or their representative upon arrival and departure from the accommodation. This inventory constitutes the sole reference in the event of a dispute regarding the inventory of fixtures. The cleanliness of the accommodation upon the tenant's arrival must be noted in the inventory. Cleaning of the premises is the tenant's responsibility during the rental period and before departure. Any cleaning fees, set at 50 euros, will be deducted from the deposit.

Article – 9 : Dépôt de garantie ou caution

Upon arrival, a security deposit is required, the amount of which will be equal to half of the invoice due to the landlord for the stay. This deposit can be paid in cash or by bank check, which will not be cashed until departure.

Après l’établissement contradictoire de l’état des lieux de sortie, ce dépôt est immédiatement restitué, sauf s’il faut en déduire le coût de remise en état des lieux si des dégradations étaient constatées.

In the event of significant damage exceeding the amount of the security deposit, the tenant, who is responsible for all damage caused by their actions, must use their civil liability insurance. In this case, the deposit will be returned once the insurance company has made the required reimbursements.

Article – 10 : Utilisation des lieux

The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises.

The tenant will not fail to read the page “Some rules of life” which he will find under the tab “The gîte in detail”.

Article – 11 : Capacité

Le gîte a une capacité d’accueil maximum de 4 personnes. Si le nombre de locataires dépasse la capacité d’accueil, le loueur peut refuser les personnes supplémentaires. Toute modification ou rupture du contrat sera en conséquence considérée à l’initiative du client.

Article – 12 : Animaux

The Gîte de la Collégiale specifies that it is not permitted to stay with pets. If the tenant fails to comply with this clause, the landlord may refuse the stay. In this case, no refund will be issued.

Article – 13: Potential imputabilities

La liste sera communiquée au moment de l’état des lieux d’arrivée.

               

Conditions General and Specific Conditions of Sale relating to a Sale of items from the Collegiate Church Flea Market

Article – 1: Purpose and scope of application

Les présentes Conditions Générales de Vente (ci-après « CGV ») ont pour objet de définir les droits et obligations de La Brocante de La Collégiale (ci-après « le Vendeur ») et de toute personne physique majeure agissant à des fins personnelles (ci-après « le Client ») dans le cadre de la vente de biens proposés par le Vendeur.

Article – 3: Products

Description

Les produits proposés à la vente sont décrits et présentés sur le site [URL] (ou autres supports) avec la plus grande exactitude possible.

However, minimal variations may exist, without engaging the responsibility of the Seller.

Availability

Product offers are valid as long as they are visible on the website or mentioned in the commercial documents, within the limits of available stocks. In the event of unavailability after placing an order, the Seller will inform the Customer as soon as possible and will offer either a replacement product or cancellation of the order with a full refund.

Article – 4: Price

Pricing

Prices are in euros (€) and include all taxes (TTC), excluding delivery charges. The Seller reserves the right to change its prices at any time. However, the price applied will be the one in effect at the time the order is validated.

Delivery costs

Delivery costs are specified to the Customer before final validation of the order and appear on the order confirmation.

Article – 5: Order

Order process

The Customer selects the desired product(s) and adds them to the basket.

  • The Customer checks the order summary (products, quantities, prices, possible costs).
  • The Customer provides billing and delivery information.
  • The Seller sends an order confirmation email along with the amount the customer will have to pay for shipping.
  • The Customer validates this order and its final price including transport costs, after having read and accepted without reservation these General Terms and Conditions.
  • The Seller sends an order confirmation email and/or proof of purchase.

Finalizing the order

Any order will be considered final after full payment of the price or according to the agreed payment terms. The Seller reserves the right to refuse or cancel any order in the event of fraud, payment incident or previous dispute with the Customer.

Article – 6: Payment

Payment terms

Payment for purchases can be made by:

  • Bank card (Visa, Mastercard, etc.)
  • Bank transfer
  • In cash in the physical store

The amount to be paid takes into account any discounts, rebates or reductions granted by the Seller, which are specified at the time of the order or in the promotional conditions in force.

Security

The Seller implements procedures to ensure the security of transactions (secure payment platform, SSL protocol, etc.).

Article – 7: Delivery

Delivery time and method

The products are delivered to the address indicated by the Customer when ordering, within the time period mentioned on the product sheet or in the order confirmation. Delivery times are given for information purposes only and do not constitute a firm commitment by the Seller.

Delay or non-delivery

En cas de retard significatif, le Client doit en informer le Vendeur pour qu’une enquête soit menée auprès du transporteur. Si le retard dépasse une durée jugée significative, le Client peut demander l’annulation de la commande et obtenir le remboursement des sommes versées.

Receipt of products

À la réception, le Client doit vérifier l’état du colis et des produits. Toute anomalie (avarie, produits manquants, colis endommagé) doit être notifiée au transporteur et au Vendeur dans un délai de [48 heures ouvrées]. La fourniture de photos sera toujours appréciée.

Article – 8: Right of withdrawal

Duration

In accordance with article L221-18 of the Consumer Code (France), the Customer has a period of 14 days from receipt of the product to exercise his right of withdrawal without having to justify his decision or pay penalties.

Pour exercer ce droit, le Client doit informer le Vendeur de sa décision en envoyant un courrier ou un e-mail sans ambiguïté. 

Return of products

The Customer returns the products in their original condition (packaging, accessories, instructions, etc.) to the address provided by the Seller, at the Customer's expense. The Seller will reimburse the Customer within 14 days of receipt of the products or proof of shipment of said products.

Exceptions

The right of withdrawal does not apply to goods:

  • Manufactured according to the Customer's specifications or clearly personalized,
  • Likely to deteriorate or expire quickly,
  • Unsealed by the Customer after delivery and cannot be returned for reasons of hygiene or health protection,
  • And, more generally, all cases provided for in article L221-28 of the Consumer Code.

Article – 9: Guarantees and after-sales service

Legal guarantee of conformity

The Seller is liable for any defects in the conformity of the goods to the contract under the conditions set out in Articles L217-4 et seq. of the French Consumer Code. If the product is not compliant, the Customer may request the repair or replacement of the product. If this is not possible or the cost is disproportionate, the Seller may offer a partial or full refund.

Legal guarantee against hidden defects

The Seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, in accordance with articles 1641 et seq. of the Civil Code.

Warranty Exclusions

The warranty does not cover damage resulting from misuse, faulty maintenance, normal wear and tear or intervention not authorized by the Seller.

Article – 10: Responsibility

The Seller is only liable in the event of proven negligence in the performance of its obligations. The Seller shall not be held liable for any indirect or financial damage. In the event of proven non-conformity or defect of a product, the Seller's liability is limited to replacing or refunding it.

Article – 11: Personal data

The Seller undertakes to respect the confidentiality of the personal data collected from the Customer and to process them in compliance with the regulations in force (GDPR and Data Protection Act). The Customer has the right to access, rectify, oppose and delete data concerning him, which he can exercise by contacting the Seller at the email address indicated in Article 2.

Article – 12: Dispute resolution and applicable law

Applicable law

These T&Cs are subject to French law.

Complaint and mediation

In the event of a dispute, the Customer must first contact the Seller's customer service to find an amicable solution. In accordance with Articles L612-1 et seq. of the French Consumer Code, the Customer may use a consumer mediator free of charge to resolve the dispute amicably.

Competent courts

In the absence of an amicable agreement or mediation, any dispute will be brought before the competent courts of Béziers or the place of residence of the Client.

Article -13: Final provisions

If any of the clauses of these T&Cs are declared null or inapplicable, the other provisions will remain in full force and effect.
